IV Seminario sobre propiedad intelectual comparada. «Legal Issues Arising from “Borrowing” Content when Preparing a Commercial Design»

Actividad de Extensión Universitaria organizada a través de las Cátedra Cultural «Francisco Tomás y Valiente» con la colaboración de Fulbright España, el Aula Cultural «Radio Campus» y Docencia en Derecho Civil., que se celebrará en la Facultad de Bellas el día 21 de octubre de 2021, en horario de 11:00 – 13:00 horas.

Objetivos:

Modern commercial design often involves borrowing elements from other sources. These borrowed elements may include text, drawings or photos, music, and overall “look and feel” of the site. However, to the extent these elements are protected by intellectual property rights owned by other people, such borrowing /*CREATEs potential liability under various intellectual property laws.

This presentation will discuss various intellectual property issues that may arise in connection with borrowing designs for use in a commercial design. While there will be some discussion of copyright, the main focus will be other intellectual property rights such as trademark/service mark, product design and publicity rights. Sometimes, these other forms of protection overlap with copyright (for example, a logo can be protected both by copyright and by trademark). However, there are also important differences between various aspects of the various forms of protection.

El seminario será una exposición teórico-práctica, con participación activa del alumnado.

Dirige: Luis Javier Capote Pérez. Profesor de Derecho Civil, Departamento de Disciplinas Jurídicas Básicas de la ULL. Miembro de la Cátedra UNESCO «Cultural Property Law» (Universidad de Opole). Miembro del consejo de redacción de la revista «Santander Art & Culture Law Review».
